Geelong Truck Rentals – Excavator Hire Terms & Conditions
- Rental Agreement
Your agreement with Geelong Truck Rentals (“We/Us/Our”) begins on the date you sign the Rental Document. It comprises the signed Rental Document and these Terms & Conditions. - Definitions
- You/Your: the hirer or authorised driver.
- Excavator: DEVELON 1.9-Ton Excavator including its trailer, components, and accessories.
- Rental Period: the period between pickup and return times specified.
- Rental Charges: daily or weekly hire rates, plus any extras (e.g. auger hire).
- Excess: any applicable insurance excess or damage liability amount.
- Authorised Operators
- Only you or a driver authorised on the Rental Document may operate the Excavator.
- All operators must hold a valid Australian driver’s licence and not under learner/provisional conditions.
- Rental Rates & Charges
- Dry Hire Rates:
- $200 per day DEVELON 1.9-Ton Excavator including its trailer, Half Hitch & 3 Buckets.
- $1,019 per full week (7 days)
- Auger Set Add-On: $50 per day (150 mm & 300 mm)
- All charges apply for the full Rental Period, regardless of actual usage.
- Tow Requirements
- Excavator includes its own trailer.
- Your tow vehicle must be capable of towing 3.5 t and fitted with electric brakes.
- Use & Operating Restrictions
- For use within Victoria only operated by a competent operator who has the necessary skills and knowledge to safely operate earthmoving equipment.
- It is the responsibility of the Hirer to ensure that the operator meets any competency and/or requirements.
- Maintenance & Safety
- Maintain engine oil and coolant levels per manufacturer’s guidelines.
- Keep the Excavator secured when unattended.
- Damage, Loss & Liability
- You are liable for loss, damage or theft to the Excavator, trailer, accessories, or third-party property caused during hire.
- You must pay:
- Any excess or damage cost.
- Cleaning or deodorising fees.
- Repair/replacement costs (including overhead/roof, underbody, or water damage).
- Appraisal, tow, storage, downtime fees, administration fees, and market value where applicable.
- Return Conditions
- Return the Excavator and trailer to Geelong Truck Rentals depot Geelong at the agreed time.
- Late returns may incur additional charges at standard daily rates.
- Excavator must be returned in the same condition as collected, fair wear and tear excepted.
- Refuel and clean before returning, failure to comply may incur a refuelling and cleaning fee of up to $300.
- Termination & Repossession
- We may require immediate return if we reasonably suspect breach of contract, unsafe use, or unlawful behaviour.
- You remain responsible for all applicable charges until the Excavator is returned or repossessed.
- Insurance & Excess
- The standard insurance excess is $2,500, which applies to all incidents of loss or damage.
- The final amount payable may vary depending on the nature and extent of the loss or damage and will be determined at the sole discretion of Geelong Truck Rentals.
- If the actual costs incurred by Geelong Truck Rentals are less than the standard excess, we may refund you the difference, at our sole discretion.
- Geelong Truck Rentals’ insurance only covers the hired plant and equipment (excavator and trailer).
- It is the Hirer’s responsibility to ensure they hold appropriate insurance coverage, including:
- Public Liability Insurance,
- Worksite Safety Compliance, and
- Third-Party Property Damage and Personal Injury coverage.
- Insurance does not cover prohibited or negligent use, such as:
- Overloading or misuse of the excavator or trailer.
- Failing to use a compliant tow vehicle with a minimum 3.5t towing capacity and electric brakes.
- Operating without proper licences or permits.
- Breach of any WorkSafe, OH&S, or local council regulations.
- Use by unauthorised operators or in unsafe conditions.
- Indemnity
You agree to indemnify and hold harmless Geelong Truck Rentals, its employees, contractors, and agents from and against all claims, damages, liabilities, losses, costs, and expenses (including legal fees) arising directly or indirectly from:
- Your use or misuse of the Excavator, trailer, or accessories during the Rental Period.
- Breach of any term of this Agreement by You or any authorised operator.
- Any injury, death, property damage, or economic loss suffered by You, your contractors, or any third party as a result of operating or towing the Excavator.
- Failure to comply with local laws, safety regulations, or council requirements while using the Excavator.
- Claims made by third parties for damage or loss caused by You or any authorised operator, including but not limited to damage to underground services, fences, roads, buildings, or other property.
This indemnity survives the completion or termination of the hire agreement.
